Kody Kaplon Sits Before a Judge for Arraignment

Kody Kaplon heads back to court.  Kaplan is now charged with attempted murder, kidnapping, and five felony counts of sexual assault with a three-year-old girl from Yreka, California.  His arraignment was held Tuesday, May 19th.  

The Yreka Police Department says the girl is with foster parents and that she has been there since she was found in the mountains outside Yreka in March.

During the arraignment, News 10 made contact with Kaplon's defense attorney, Andy Marx.  He says, at this time, he has no comment concerning Kaplon or the case.  But during a preliminary hearing held earlier in the month, Marx mentioned that the girl said "some very inconsistent and even impossible things" in interviews with police.  The Yreka Police Department did say that during her interviews the girl said she was dreaming that someone was choking her in the mountains where she was found.

Lt. Dave Gamache of the Yreka Police Department says, "When a person is choked out, lack of oxygen to the brain creates kind of a euphoric state or altered state of consciousness prior to going unconscious."

Police say the girl also told them Kaplon tried to bury her.  At the preliminary hearing Sergeant Ray Boutin said the girl had visible bruises and abrasions across her throat.  So, police say if the girl was choked that could have something to do with her "dream".  

Police say the girl called the person who took her from the home 'Jack', 'Jacko', or 'Mr. Man'.  They say when they showed her a photo lineup of different people, she pointed to Kaplon and told them that was Jacko.  

The preliminary hearing for Kaplon was set for June 16th at 9 a.m.
